By installing or using RecallDocket (the "Service") you ("Merchant", "you") agree to these Terms of Service. If you do not agree, do not install or use the Service.
RecallDocket compares a Shopify merchant's product catalog against the public U.S. CPSC recall feed and provides tooling to review matches, notify customers, and prepare a CPSC Section 15(b) report. RecallDocket does not file reports with the CPSC on your behalf.
RecallDocket is software, not legal counsel. The matching engine is heuristic and may produce false positives or false negatives. Compliance decisions — including whether to remove a product, notify customers, or file a Section 15(b) report — remain your sole responsibility. Consult qualified product-safety counsel for any decision that has legal consequences.
Paid plans are billed via the Shopify Billing API and appear on your Shopify invoice. Prices are listed in USD. You can cancel any time from inside the app; cancellation takes effect at the end of your current Shopify billing cycle.
RecallDocket acts as a data processor for the merchant data described in our Privacy Policy. We process data only to operate the Service and never sell merchant or customer data to third parties.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL DETECT EVERY APPLICABLE RECALL OR THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALLDOCKET'S AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE FEES YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (b) USD $100. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA.
You agree to indemnify and hold RecallDocket harmless from any claim arising from your use of the Service in violation of these Terms or applicable law, including CPSC reporting obligations and customer-notification obligations.
You may terminate these Terms at any time by uninstalling the app from Shopify. We may suspend or terminate access for violation of these Terms.
Your use of the Service is also subject to Shopify's terms, including Shopify's API License and Terms of Use and the Shopify App Store Terms. Where there is a conflict between these Terms and Shopify's terms with respect to data handling, the stricter requirement governs.
We may update these Terms; material changes will be announced in-app at least 14 days before they take effect.
